SKY RACING ACTIVE SPRING RACING CARNIVAL PROMOTION
1. General Entry
Information on how to enter and prizes form part of these conditions of entry. By entering and/or participating in the ‘Sky Racing ACTIVE Spring Racing Carnival Promotion (“Promotion”), each participant fully and unconditionally agrees and acknowledges that these Conditions of Entry and the decision of the Promoter on all matters relating to this Promotion is final and binding.
Entry is open to all residents of Victoria aged 18 years and over who hold a Victorian TAB account and subscription to Foxtel.
Directors, Officers and Employees of, or contractors to, the TABCORP Group of Companies, their immediate families and all TABCORP agencies and companies associated with this promotion are not eligible to enter.
"immediate families" means a spouse (including de facto), parent, sibling, child, grandparent, grandchild, or parent in law and includes stepparents and stepchildren and half siblings.
All participants and Promotion winners consent to the publication of their name and suburb of residence (however their full address will not be published) and agree to participate in reasonable promotional activities as requested by TABCORP.
2. Terms of Promotion
The Promotion commences on Saturday 11th October, 2008 at 12:00am (AEST) and concludes on Sunday 16th November 2008 at 23:59pm (AEST) (“Promotional Period”).
3. How to Enter
To enter the Promotion, Victorian TAB account holders (Account Holders) must place a bet of $10 or more on Sky Racing ACTIVE throughout the Promotional Period. Every individual bet of $10 or more will earn the customer one entry for their chance to win.
TABCORP reserves the right to disqualify any entry if that entry is not made in accordance with the terms of these Conditions of Entry.
Each time an Account Holder connects to Sky Racing ACTIVE, a local call fee will be charged to the TAB Account Holder’s telephone account.
4. Prizes
MINOR PRIZES
The first runners-up (‘First Runners-Up’) prize is an LG 52LG65YD 52inch Full HD LCD television valued at AUD $4,999.00
The second runners-up (Second Runners-Up’) prize is an LG 32LG6UD 32 inch Integrated HD LCD television valued at AUD $1,899.00
Total Minor Prize Pool: $6,898.00
MAJOR PRIZE
The major prize “Major Prize” is a Dubai World Cup package for two departing 22nd March and returning 31st March 2009. Package including the following:
- Return economy class airfares on Emirates Airlines or similar from Melbourne, Sydney, Brisbane or Perth to Dubai, United Arab Emirates
- Compulsory pre-paid airfare taxes
- 7 nights accommodation at 4 Star Superior First Class Modern Hotel
- Buffet Breakfast daily
- Return Deluxe Private car Dubai Airport to Accommodation Transfers.

Total Value of the Major Prize AUD $14,756.00
Total Prize Pool: AUD $21,654.00
All prizes must be taken as offered and cannot be varied.
Major Prize: Australian passport holders can obtain a Visa for United Arab Emirates on arrival. Should the Winner of the Major Prize hold a passport from another country, the Winner will need to arrange the Visa.
The Major Prize Winner and guest must ensure that there is at least 6 month validity on their passports.
Prize values are GST inclusive, are in Australian dollars.
The prize cannot be transferred to another adult.
The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and to disqualify any participant who tampers with the entry process, including but not limited to, techniques designed to submit an entry that is not in accordance with these Conditions of Entry. The Promoter also reserves the right to request winners to provide proof of age, identity and proof of being a TAB account holder.
Incomplete or incomprehensible entries, determined in the sole discretion of the Promoter, will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries.
In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.
The winner must sign and return any liability release provided by TABCORP as a condition of the prize being awarded. Failure to return the signed release(s) will result in the entitlement to the prize being forfeited and the selection of another winner.
5. Prize Draws
The winners will be randomly selected using a random number generator on Monday 17 November 2008 at 12:00pm at Tabcorp’s New South Wales Office located at 495 Harris Street, Ultimo NSW 2007. The first drawn entry will win the Major Prize. The second entry drawn will win the First Runners-Up Prize, the third Entry drawn will win the Second Runners-Up prize.
6. Winner Notification
Winners will be notified by telephone/email and/or mail. All winners will be published in the Public notices section of the Herald Sun on Thursday 20 November 2008. All effort will be made to contact each of the Winners.
7. Tax Statement
Any taxes which may be payable as a consequence of the winner receiving the prize are the sole responsibility of the winner. TABCORP accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial and tax advice should be sought.
8. Exclusion of Liability
To the extent permitted by law, TABCORP is not liable for any loss, including, but not limited to, direct, consequential (including economic) or indirect loss or any loss of profits, by reason of any act or omission, deliberate or negligent, by TABCORP or their servants or agents, in connection with this Promotion or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to an participant or the prize winner.
Nothing in these Official Rules affects, nor is intended to affect, any rights a consumer might have which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of TABCORP or their servants or agents for breach of any such rights is limited to the supplying of the relevant goods or services again.
9. General Conditions
TABCORP, its employees, officers, agents, and its parent companies and subsidiaries are not responsible for and shall not be liable for:
(i) any condition caused by events beyond the control of TABCORP that may cause the game to be disrupted or corrupted;
(ii) any injuries, losses (including, without limitation, loss of profits), or damages of any kind (even where resulting from negligence of TABCORP or any other person) caused by the prize or resulting from acceptance, possession, use, or misuse of the prize, or from participation in the game or downloading material from the website; or
(iii) any printing or typographical errors in any materials associated with the Promotion
TABCORP reserves the right, in its sole discretion, to cancel or suspend the Promotion, should virus, bugs, unauthorized human intervention, or other causes beyond the control of TABCORP, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the game or to disqualify any participant who engages in offensive, illegal or objectionable conduct. TABCORP reserves the right in its sole discretion to disqualify any individual who tampers with the entry process including but not limited to, techniques designed to avoid payment of call costs, or who submits an entry that is not in accordance with these Conditions of Entry. The promoter also reserves the right to request winners to provide proof of age, identity or proof of residency at the nominated prize delivery address.
If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by any relevant government or regulatory authority, to cancel, terminate, modify or suspend the promotion.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
Programming and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these conditions of entry, all valid prize claims in excess of the advertised prize pool will be honoured. All entries become the property of TABCORP. The information participants provide will be used by TABCORP for the purpose of conducting this Promotion. TABCORP may disclose participants' personal information to its contractors and agents to assist in conducting this Promotion or communicating with participants.
By entering the Promotion, participants consent to their personal information being collected, used and disclosed by the Promoter, its agents, affiliates, related business companies, other companies associated with this promotion, and business partners for any promotional activities, including the participant's personal participation in reasonable promotional activities as requested by the Promoter, any marketing and publicity purposes without any further reference, payment or other compensation to the participant. The participant's consent includes authorising the Promoter, its agents, affiliates, related business companies, other companies associated with this promotion and business partners to send the participant future electronic messages including but not limited to, SMS, MMS, and email regarding any promotional, marketing and publicity activities.
Participants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
Decisions of the management of the Promoter are final. No correspondence will be entered into.
The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion. To the extent that a situation or issue arises for which these Conditions of Entry make no provision or in relation to which the relevant Conditions of Entry are unclear, the Promoter also reserves the right to make a decision regarding such situation or issue in its sole and absolute discretion and such decision will be final and binding.
10. Unclaimed prize draw
If prizes are not claimed within 3 months after the completion of the promotion, an unclaimed prize draw will be conducted at AEST 10.00 a.m. on the Thursday 19th February 2009 at Tabcorp’s New South Wales Office located at 495 Harris Street, Ultimo NSW 2007. Any unclaimed prize draws will be published in the Herald Sun on Tuesday 24th February 2009 and winners will be notified by mail and phone.
